2010 Proposed Alabama Constitutional Amendments


Amendment #1: Allow fees to be charged to collect special ad valorem taxes.
Proposing an amendment to the Constitution of Alabama of 1901, to provide that the provision in Amendment 778, now appearing as Section 269.08 of the Official Recompilation of the Constitution of Alabama of 1901, as amended, which prohibits the payment of any fees, charges, or commissions for the assessment and collection of any special ad valorem tax on taxable property levied by the county commission pursuant to Amendment 778 (Section 269.08) shall only apply to any ad valorem tax first levied and collected pursuant to Amendment 778 (Section 269.08) for the tax year commencing October 1, 2006. (Proposed by Act No. 2009-286)


Amendment #2: Allow special county educational taxes to pass by a majority vote, instead a three-fifths vote.
Proposing an amendment to the Constitution of Alabama of 1901, to amend to Section 269 of the Constitution of Alabama of 1901, as amended by Amendment No. 111 to the Constitution of Alabama of 1901, now appearing as Section 269 of the Official Recompilation of the Constitution of Alabama of 1901, as amended, relating to special county educational taxes, to provide that the taxes may be levied by a majority vote, not by three-fifths vote, of those voting at the election. (Proposed by Act No. 2009-551)


Amendment #3: Allow the appropriation of funds in the Alabama Trust Fund to state and local transportation purposes, as well as provide funds to the County and Municipal Government Capital Improvement Fund.
Proposing an amendment to the Constitution of Alabama of 1901, relating to the Alabama Trust Fund, to provide for the appropriation of funds in the Alabama Trust Fund to be distributed for state and local transportation purposes and to provide for funds for the County and Municipal Government Capital Improvement Fund. (Proposed by Act No. 2010-555)

Amendment #4: Prohibit a municipality outside Blount County from imposing ordinances for inside Blount County.
Relating to Blount County, proposing an amendment to the Constitution of Alabama of 1901, to prohibit any municipality located entirely outside of Blount County from imposing any municipal ordinance or regulation, including, but not limited to any tax, zoning, planning, or sanitation regulations, and any inspection service in its police jurisdiction located in Blount County and to provide that a municipality prohibited from imposing any tax or regulation under this amendment shall not provide any regulatory function or police or fire protection services in its police jurisdiction located in Blount County, other than public safety mutual aid. (Proposed by Act No. 2010-226)


Proposed Local Amendment Number One (Madison): Prohibit the imposition of an occupational tax.
Relating to Madison County, proposing an amendment to the Constitution of Alabama of 1901, to prohibit the imposition of an occupational tax. (Proposed by Act No. 2010-37)


Proposed Local Amendment Number Two (Madison): "To establish a procedure by which a dog can be declared dangerous, to impose civil penalties on the owner of a dog that inflicts severe personal harm on another person, and to require that dangerous dogs be kept in a fenced enclosure with input from the local humane society."
Proposing an amendment to the Constitution of Alabama of 1901, for those areas outside the corporate limits of any municipality, to authorize the Madison County Commission, by resolution, to establish a procedure by which a dog can be declared dangerous, to impose civil penalties on the owner of a dog that inflicts severe personal harm on another person, and to require that dangerous dogs be kept in a fenced enclosure with input from the local humane society. (Proposed by Act No. 2010-382)


Proposed Local Amendment Number One (Limestone): Prohibit the imposition of an occupational tax.
Relating to Limestone County, proposing an amendment to the Constitution of Alabama of 1901, to prohibit the imposition of an occupational tax. (Proposed by Act No. 2010-128)


Proposed Local Amendment Number One (Morgan): Prohibit the imposition of an occupational tax.
Relating to Morgan County, proposing an amendment to the Constitution of Alabama of 1901, to prohibit the imposition of an occupational tax. (Proposed by Act No. 2010-112)
